These Terms and Conditions (“Terms”) govern your use of the SketchTales mobile application, website, and related services (the “Services”).
By accessing or using the Services, you agree to these Terms.
1. User Content
You may upload drawings, sketches, doodles, text prompts, voice recordings, or other creative content (“User Content”).
You retain ownership of your User Content.
You grant SketchTales a limited, non-exclusive licence to process, display, reproduce, and modify User Content solely for:
- Operating the Services,
- Generating animations and creative outputs,
- Improving app functionality,
- Providing technical support.
You represent that:
- You own or have permission to upload the content,
- The content does not violate laws or third-party rights,
- The content is appropriate for a family-oriented platform.
2. AI-Generated Content
The Services may use artificial intelligence to generate animations, voices, stories, images, or related creative outputs.
You acknowledge that:
- AI-generated outputs may not always be accurate or appropriate,
- Outputs may occasionally contain unexpected or unintended results,
- We do not guarantee uniqueness of generated content.
Parents and guardians are responsible for reviewing generated content before sharing it with children.
3. Acceptable Use
You agree not to:
- Upload unlawful, abusive, or harmful content,
- Upload content infringing intellectual property rights,
- Attempt to exploit or manipulate AI systems,
- Reverse engineer or interfere with the Services,
- Use the Services for commercial exploitation without permission.
We reserve the right to remove content or suspend accounts violating these Terms.
4. Child Safety
The Services are intended to provide a safe, family-friendly creative environment.
We prohibit:
- Sexual or exploitative content involving minors,
- Violent or hateful content,
- Bullying, harassment, or abusive behaviour,
- Attempts to identify or target children.
We may remove content or terminate accounts that violate child safety standards.
5. Subscriptions and Purchases
Some features may require paid subscriptions or in-app purchases.
Subscriptions automatically renew unless cancelled through your Apple App Store or Google Play account settings before renewal.
Except where required by law, fees are non-refundable.
6. Intellectual Property
All software, branding, graphics, animations, interfaces, and technology associated with the Services are owned by or licensed to SketchTales.
Except as expressly permitted, you may not:
- Copy,
- Modify,
- Distribute,
- Sell,
- Reverse engineer,
- Exploit any part of the Services.
7. Privacy
Your use of the Services is also governed by our Privacy Policy.
8. Disclaimer of Warranties
The Services are provided “as is” and “as available.”
To the fullest extent permitted by law, we disclaim warranties including:
- Merchantability,
- Fitness for a particular purpose,
- Accuracy,
- Availability,
- Non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law, SketchTales shall not be liable for:
- Indirect or consequential damages,
- Loss of data,
- Loss of creative content,
- Service interruptions,
- AI-generated inaccuracies,
- Third-party actions.
Our total liability shall not exceed the amount paid by you for the Services during the previous 12 months.
10. Termination
We may suspend or terminate access to the Services if:
- You violate these Terms,
- Misuse is suspected,
- Continued operation becomes unlawful or impractical.
You may stop using the Services at any time.
11. Changes to the Services or Terms
We may modify the Services or these Terms from time to time.
Continued use after changes become effective constitutes acceptance of the updated Terms.
12. Governing Law
Except for disputes that can be brought in small claims court, all disputes between you and us, including any dispute regarding this Agreement, shall be exclusively settled through binding arbitration through the American Arbitration Association (“AAA”) pursuant to the AAA’s then-current rules for commercial arbitration. Any such arbitration proceeding will be conducted solely in English.
These Terms are governed by the laws of the State of Delaware without regard to conflict of law principles. If the arbitration in this section provision is found unenforceable or not to apply for a given dispute, then the proceeding must be brought exclusively in a court of Delaware jurisdiction.
